On May 19, 1966, plaintiff in error (hereinafter defendant), Ronald Gray, was tried and convicted of rape in violation of sec. 944.01, Stats. Trial was to the court without a jury. Subsequent to his conviction, defendant moved the trial court for dismissal or, in the alternative, for a new trial. The motion urged one ground for dismissal: That the arrest warrant was defective because it was not based upon a sworn complaint. The alleged grounds for a new trial were: (1) Good cause existed for the admission of alibi testimony even though the statutory notice had not been given; and (2) the prosecution failed to present certain evidence and witnesses favorable to the defense. The trial court denied the motion. Defendant brings this writ of error to challenge the denial of his motion. On this appeal, defendant raises the additional claim that the evidence in the trial is insufficient to support the conviction.
